The California Highway Patrol has agreed to a settlement of the recent case of a pregnant driver, Tamara Gaglione, 30, being hogtied by police after being stopped for talking on her cellphone. Gaglione will receive a $250,000 settlement.
The video below shows Gaglione weaving between lanes before being stopped. The officers claimed that she raised her arms in a menacing manner. However, the video shows Gaglione not responding to instructions to throw out her keys and put her hands on the van. Instead she just stares at the officers who have their guns drawn. One officer then kicks out her legs and pushing her to the ground. One officer appears to kick Gaglione while she is on the ground and before she was hogtied. Police told her lawyer initially that there was no video and her attorney says that he was only shown the video after he persisted in his demands.
She was charged with evading arrest and driving on a suspended license. Those charges were dismissed and Gaglione pleaded no contest to using a cellphone while driving.
Officer Daniel Hernandez says that he kneed the woman in an effort to distract her so that his partner, Officer Roberto Martinez, could handcuff her. The officers say that it was Gaglione who escalated the incident to violence by raising her arms in a menacing fashion . . . in front of officers with their guns drawn.
In watching the video below, I fail to see any menacing conduct at all. I do see a driver who is weaving into traffic rather than pull over immediately and then ignore the instructions of the officers. There is no apparent justification for taking down the woman and then kneeing her on the ground — let alone the hogtying. There is no indication that any officer has been disciplined for this conduct.

I hate cops as much as the next guy, but when they tell me to pull over, etc, I do it simply because I am afraid of the power they have over me. This video proves that they won't hesitate to arrest, with violence, some person who they imagine is disrespecting their authority. This woman should be celebrating her lottery win, because she eventually had the last laugh on the pig who assaulted her.

I don't know what you want me to do." Kind of like a shrug of confusion. 2. In a fashion where she was letting the police no that she meant no harm by putting her arms in the air. Not all the way, but mid way. They were visibly up. How can this stuff happen continually when corruption is visibly present in the video?

She got what she deserved. If a cop tells me to throw my keys out the window, guess what? I throw my keys out the window. If they tell me to put my hands on the vehicle, guess what? I put my hands on the vehicle.

 | Det John McClane It's morons like this lady that make day-to-day life so miserable on the streets. No respect, whatsoever, for the authority of the cops. She was CLEARLY ignoring them and continued driving, attempting to weave her way through the standstill traffic. With the presence of the police, now the entire area and all of the other drivers are inconvenienced because of this one, single a$$hole. For the life of me, I don't understand why these morons always get a settlement. She's lucky she didn't get more of an ass beating. She should have. Based on her name and her blank stare at the cops, one wonders if she is just another of the hoards of immigrants flooding our country. It appeared as though she didn't understand what the cops were saying to her. She certainly is unaware of the law, stating you PULL OVER NOW when a cop signals you. Should have gotten a little more beating if you ask me.
